1. Agreement to Terms

By accessing our website (nightridernotary.com) or using our services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

These Terms of Service apply to all users of the site, including browsers, customers, and other users of the service.

2. Services Provided

Nightrider Notary provides the following services:

• Document Courier Services: Secure transportation and delivery of documents within our service area
• Mobile Notary Services: On-location notarization services (available Q2 2026 upon commission approval)
• After-Hours Services: Evening and weekend appointments as scheduled

All services are subject to availability, scheduling, and geographic limitations as outlined on our website.

3. Service Area and Availability

Our services are available within a 50-mile radius of Auburn, Washington. Service availability includes:

• Monday through Friday: 5:00 PM to 10:00 PM
• Weekends: By appointment only
• Holidays: By appointment only

We reserve the right to refuse service outside our designated service area or operating hours.

4. Booking and Appointments

Scheduling

Appointments must be scheduled in advance through our contact form or by phone. Same-day service may be available but is not guaranteed.

Cancellations

Cancellations must be made at least 2 hours prior to the scheduled appointment time. Cancellations made with less than 2 hours notice may be subject to a cancellation fee.

No-Show Policy

If you are not present at the scheduled location within 15 minutes of the appointment time, the appointment may be considered a no-show and full payment may be required.

5. Pricing and Payment

Service Fees

Pricing for our services is as follows:

• Document Courier Services: $100-$150 per delivery (based on distance and urgency)
• Mobile Notary Services: Pricing to be determined upon service launch
• Additional fees may apply for rush services, after-hours requests, or extended distances

Payment Terms

Payment is due at the time of service unless other arrangements have been made in advance. We accept the following payment methods:

• Credit and debit cards
• Electronic payment services
• Cash (exact change appreciated)

Late Payments

Late payments may be subject to additional fees and may result in suspension of future services until the balance is paid in full.

6. Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information when scheduling services
• Be present at the scheduled location at the agreed-upon time
• Have all necessary documents and identification ready
• Ensure documents are complete and ready for delivery or notarization
• Comply with all applicable laws and regulations
• Treat our staff with respect and professionalism
• Provide a safe and accessible location for service delivery

7. Notary Services (When Available)

Notarial Acts

When our notary services become available, all notarial acts will be performed in accordance with Washington State law and regulations. The notary has the right to refuse any notarization that does not meet legal requirements.

Identification Requirements

Valid government-issued photo identification is required for all notarizations. Acceptable forms include:

• Driver's license or state ID card
• U.S. passport or passport card
• Military ID
• Other government-issued photo identification

Signer Competency

The notary must be satisfied that all signers are acting of their own free will, are competent, and understand the document they are signing. The notary reserves the right to refuse service if there are concerns about competency, coercion, or fraud.

8. Document Courier Services

Handling and Care

We will exercise reasonable care in handling and transporting your documents. Documents will be kept secure and confidential throughout the delivery process.

Prohibited Items

We do not transport:

• Cash, checks, or other negotiable instruments (unless specifically arranged)
• Illegal or controlled substances
• Weapons or hazardous materials
• Items that violate local, state, or federal law

Delivery Confirmation

Upon delivery, we will obtain a signature or other confirmation of receipt. You will be notified when delivery is complete.

9. Liability and Limitations

Service Limitations

While we strive to provide excellent service, we cannot guarantee specific delivery times due to factors beyond our control, including traffic, weather, and other unforeseen circumstances.

Limitation of Liability

Our liability for any claim related to our services is limited to the amount paid for the specific service in question. We are not liable for indirect, incidental, special, or consequential damages.

Insurance Coverage

We maintain general liability insurance and commercial auto insurance as described on our website. Claims must be reported within 30 days of the incident.

Force Majeure

We are not responsible for failure to perform services due to causes beyond our reasonable control, including natural disasters, acts of government, strikes, or other force majeure events.

10. Confidentiality and Privacy

We respect your privacy and will maintain the confidentiality of your documents and personal information in accordance with our Privacy Policy and applicable laws.

Notarial records will be maintained as required by Washington State law for a minimum of 10 years.

11. Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of Nightrider Notary and is protected by copyright and other intellectual property laws.

You may not reproduce, distribute, or create derivative works from our website content without express written permission.

12. User Conduct

You agree not to:

• Use our services for any illegal or unauthorized purpose
• Harass, threaten, or abuse our staff
• Provide false or misleading information
• Interfere with or disrupt our services or servers
• Attempt to gain unauthorized access to our systems
• Violate any applicable local, state, or federal laws

Violation of these terms may result in immediate termination of services and potential legal action.

13. Refund Policy

Refunds are considered on a case-by-case basis. You may be eligible for a refund if:

• We fail to provide the service as scheduled (without prior notice)
• The service does not meet the agreed-upon specifications
• You cancel with adequate notice (as specified in Section 4)

Refund requests must be submitted within 7 days of the service date. Approved refunds will be processed within 14 business days.

14. Dispute Resolution

Informal Resolution

If you have a complaint or dispute, please contact us first at isaiah@nightridernotary.com. We will make good faith efforts to resolve any issues informally.

Governing Law

These Terms of Service are governed by the laws of the State of Washington, without regard to its conflict of law provisions.

Jurisdiction

Any disputes arising from these terms or our services shall be resolved in the courts of King County, Washington.

15. Indemnification

You agree to indemnify and hold harmless Nightrider Notary, its owner, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from your use of our services, violation of these terms, or violation of any rights of another party.

16. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website with an updated "Last Updated" date.

Your continued use of our services after changes are posted constitutes acceptance of the modified terms. We encourage you to review these terms periodically.

17. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Nightrider Notary regarding the use of our services and supersede all prior agreements and understandings.

19. Waiver

Our failure to enforce any right or provision of these Terms of Service will not be considered a waiver of those rights. Any waiver of any provision of these terms will be effective only if in writing and signed by an authorized representative.
